Legal aspects of artificial intelligence applications in orthopedics and traumatology

Artificial Intelligence is expected to offer the highest benefit in the field of healthcare, providing very important information in diagnosis, treatment and prognosis and is considered to be increasingly beneficial. It has started to be used in diagnosis, treatment and even follow-up in orthopedics and traumatology practice. It is not yet clear in the current legal system that who is responsible for the damage that may occur in the medical practices of the orthopedics and traumatology specialist, where artificial intelligence is used, and to what extent. This situation raises the question of how artificial intelligence`s liability and possible damage will be regulated. There is no regulation regarding the legal status of artificial intelligence in our country yet. In this regard, a regulation is required in the Turkish legal system by following the approaches of other countries and evaluating doctrinal views. In our article, the current legal order and whether it is sufficient or not will be evaluated, considering the need for the issue to be regulated by the legal system. The aim is to examine the issue within the framework of the current legal system and to reveal an opinion about the regulations that can be carried out.
