Medical malpractice, a multi-component issue with its legal, medical, ethical, educational and managerial aspects, is a situation that non of our colleagues would want to encounter. In addition to conscientious punishment of the clinician in such situation, it is also inevitable for him/her to enter a difficult process both financially and psychologically with the legal penalty after the possible litigation. Orthopaedics and Traumatology is the most physically challenging of all surgical departments, therefore malpractice cases are more likely to occur. It gives an extremely high level of occupational satisfaction, but unfortunately it is a department that does not tolerate the mistakes. To minimize our medical malpractice, we have to know the standards of Orthopaedics and Traumatology very well, develop our knowledge and skills, and take care of recording all practice and patient-related information, and especially should not neglect patient`s informed consent. Most important of all is to be in good communication with the patient.
